1. Overview

AcrossPay is a payments technology company focused on bridging crypto and fiat payments. Our products and services are designed to let users view, send, receive, and interact with certain blockchain-based digital assets and to enable crypto-to-fiat payment flows via integrated third parties (collectively, the “Services”). The Site is primarily informational and provides product descriptions, documentation, developer resources, and downloads. The App (which may be a mobile application, browser extension, or other software) enables users to interact with supported blockchains, connect to third-party decentralized applications (Dapps), access swap functionality, and use crypto-to-fiat rails offered through partnerships.

Key plain-English points:

  • The Site is informational, it does not require login and does not collect personal data except for optional feedback you voluntarily submit.

  • The App may permit you to self-custody Digital Assets, connect to third parties, and use crypto-to-fiat functionality. AcrossPay is not a custodian of your Digital Assets and does not control your private keys unless you explicitly opt into a separate custodial product offered by a third party.

  • The App may enable spending crypto through partner card rails (for example, Visa-linked flows) — in those flows, crypto is converted to fiat at the point of payment by third-party partners; across that process, the merchant receives fiat currency and not crypto. Specifics are described below.

These Terms and our Privacy Policy (the “Privacy Policy”) govern your access to and use of the Site, the App, and the Services. The Privacy Policy is incorporated by reference.

Certain App features may require creating an account or wallet. Where the App enables a self-custody wallet:

  • You (not AcrossPay) control and hold Authentication Methods necessary to access and transfer your Digital Assets.

  • AcrossPay does not custody or hold your Digital Assets unless you explicitly opt into a separately provided custodial service by a third party. AcrossPay cannot access or restore your Authentication Methods if you lose them.

  • You are solely responsible for safeguarding your Authentication Methods. Anyone who obtains your Authentication Methods may access, transfer, or spend your Digital Assets.

  • AcrossPay is not responsible for any loss arising from your failure to secure Authentication Methods, or unauthorized access to them.

If the App offers optional cloud-backed key storage or custodial services via third parties, those services will be subject to separate terms and disclosures presented when you opt in.

7. Functionality — Crypto, Fiat, Swaps, and Visa-linked Flows

7. Functionality — Crypto, Fiat, Swaps, and Visa-linked Flows

The App may enable you to:

  • View balances and transactions for supported blockchains and Digital Assets.

  • Connect to Dapps and third-party services.

  • Send and receive Digital Assets via supported blockchains.

  • Perform peer-to-peer or routed swaps where execution and quotes are provided by Swappers or other third parties.

  • Interact with third-party on/off ramp providers, banks, card networks, and processors to convert crypto to fiat (crypto-to-fiat) or fiat to crypto (fiat-to-crypto).

Crypto-to-Fiat via Card Networks (e.g., Visa) — How it works

When you choose to pay with crypto through a Visa-linked flow (or similar card network flow) using the App or a partner card/app:

  • Conversion at Point of Sale : At the moment of payment, the App or an integrated third-party partner converts your selected Digital Asset (for example, USDT, USDC, BTC) into fiat currency (for example, INR, USD) using live market quotes from Swappers, market makers, or exchange partners. Conversion rates and applicable fees may be different from market prices and are typically visible to you at the time you authorize the payment.

  • Card Network Processing : Once conversion completes, the payment is routed through the card network (for example, Visa) in the same way as a normal card transaction. The merchant receives fiat currency (not crypto) from the partner that processed the card transaction.

  • Settlement and Timing : Settlement to the merchant is handled through the card network and partner bank rails; timing and settlement mechanics are subject to the rules of the card network and the partner bank.

  • Third-Party Role : AcrossPay facilitates access to the conversion and card routing through partners but does not itself perform the conversion or act as a card network. The actual conversion, routing, authorization, and settlement are performed by third-party partners (exchanges, market makers, processors, card issuers, or banks).

Important points about Visa-linked or card flows:

  • AcrossPay relies on third-party partners for conversion and card processing. We do not guarantee availability, pricing, or settlement speed of partner services.

  • Swap or conversion quotes presented in the App are estimates and may change before execution; final executed amounts, exchange rates, and third-party fees are determined at the time of execution.

  • The merchant receives fiat currency; merchants do not receive crypto in a Visa-linked flow.

  • Fees: network fees, conversion fees, partner fees, card processing fees, and any taxes are your responsibility and may be disclosed by the partner at the time of the transaction.

Liability: AcrossPay is not liable for partner errors, failed conversions, card network declines, or delays caused by partners or the card network. See Sections 12, 13 and 15 (Fees; Risk Acknowledgement; Limitation of Liability).
